These Terms of Use govern access to and use of Gusty, including the Gusty web app, mobile app, backend services, APIs used by the app, forecast displays, charts, spot information and related services.
By using Gusty, you agree to these Terms.

2. App Store terms
If you use Gusty through the Apple App Store, Apple’s Standard End User License Agreement applies to the licensed mobile app unless Gusty provides a separate app license.
These Terms apply to the Gusty service, accounts, web app, data, content and related features.
If these Terms conflict with Apple’s Standard End User License Agreement for the app license only, Apple’s Standard End User License Agreement controls for that app license.
3. What Gusty provides
Gusty provides watersports focused weather, wind, water, tide, spot and forecast information for personal planning and decision support.
Gusty is not safety equipment, emergency guidance, professional meteorological advice, nautical advice, rescue advice, or a substitute for your own judgment.
4. Accounts
Some features may require an account.
You are responsible for keeping your device, email account and sign-in access secure. You must not use another person’s account without permission or let another person impersonate you through your account.
Gusty may suspend or terminate access if an account is used to abuse the service, bypass restrictions, scrape data, attack infrastructure, create security risk, infringe rights, or violate these Terms.
5. Safety and personal responsibility
Kitesurfing and related watersports involve inherent risks, including injury or death.
Weather, wind, water and tide conditions can change quickly. Forecasts, measurements, model outputs, spot information, charts and recommendations may be inaccurate, delayed, incomplete, unavailable, or unsuitable for your exact location.
You are responsible for:
- checking local conditions;
- checking official warnings;
- understanding local tides, currents, water hazards and rules;
- using appropriate equipment and safety gear;
- riding within your ability;
- seeking local knowledge where needed;
- deciding whether conditions are safe.
Do not rely on Gusty as your only source of information.

6. Acceptable use
You must not:
- copy, scrape, bulk download, resell or republish Gusty data without written permission;
- reverse engineer, attack, overload or interfere with Gusty systems, except where allowed by law;
- bypass authentication, access controls, entitlements, rate limits or security measures;
- use Gusty for unlawful, harmful, fraudulent or misleading purposes;
- upload, transmit or attempt to introduce malicious code;
- misuse support channels;
- remove attribution or misrepresent Gusty output as official safety guidance;
- use Gusty in a way that harms the service, other users, or third-party providers.
7. Forecasts, data and third-party services
Gusty relies on third-party data sources and service providers for hosting, authentication, maps, weather data, water data, tide data, forecasts and related functionality.
Third-party data and services may be inaccurate, delayed, incomplete, unavailable, discontinued or changed without notice.
Gusty does not control third-party data sources and is not responsible for third-party services outside its control.
8. Availability and changes
Gusty is under active development.
Features, supported spots, forecast models, data sources, charts, account features and product behaviour may change over time.
Gusty may be unavailable during maintenance, outages, provider failures, technical incidents or other events.
Gusty may change, suspend or discontinue parts of the service where reasonably necessary.
9. Paid features
Gusty may offer paid features in the future.
If paid features are offered, pricing, renewal, cancellation and refund information will be shown before purchase.
If digital features are purchased through an app store, the app store’s purchase, cancellation and refund rules may apply.
10. Intellectual property
Gusty, including its software, design, interface, text, charts, data presentation, names, marks and original content, is owned by Gusty or its licensors.
These Terms do not transfer ownership of Gusty or its content to you.
You may use Gusty for personal planning and decision support. You may not copy, resell, redistribute or build a competing service from Gusty content or data unless Gusty gives written permission.
11. Feedback
If you send ideas, suggestions or feedback, Gusty may use them to improve the app without owing compensation or attribution, unless separately agreed.
12. Privacy
Gusty’s handling of personal data is described in the Privacy Policy and Cookie Notice.
13. Account deletion and termination
You may stop using Gusty at any time.
Where account deletion is available, you may request deletion through the app or by contacting support@gusty.be.
Gusty may suspend or terminate access if you violate these Terms or create legal, security, operational or abuse risk.
14. Disclaimers
Gusty is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, Gusty does not guarantee that:
- forecasts, measurements, charts or recommendations are accurate;
- the service will be uninterrupted or error-free;
- any specific spot, session, route or condition is safe;
- third-party data will remain available;
- defects will always be corrected.
15. Liability
To the maximum extent permitted by law, Gusty is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost data, lost sessions, equipment damage, or losses resulting from reliance on weather, wind, water, tide, map, spot or forecast information.
Nothing in these Terms limits liability where the law does not allow it to be limited, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence where such limitation is not permitted.
16. Consumer rights
Nothing in these Terms limits mandatory consumer rights that cannot be excluded under applicable law.
If you are a consumer in the European Union, you may have mandatory rights under the laws of your country of residence.
17. Governing law
These Terms are governed by the laws of Belgium, unless mandatory consumer law in your country gives you additional rights.
