Privacy policy

Gusty is a watersport weather and planning app. This Privacy Policy explains how Gusty collects, uses, shares and protects personal data.

In this Privacy Policy, “Gusty”, “we”, “us” and “our” refer to the operator above.

2. Scope

This Privacy Policy applies to the Gusty web app, mobile app, related backend services, support communications and legal pages.

It does not apply to websites, services or data sources that Gusty does not control.

3. Personal data we process

Gusty may process the following personal data.

Account data

This includes email address, display name if provided, account identifiers, account status and authentication information.

Profile and preference data

This includes saved spots, home spot, favourite spots, wind units, display settings, theme, chart preferences and similar product settings.

Location data

If you use a closest-spot or location-based feature, your device may ask for permission to use your location.

When you choose to use that feature, Gusty may process your latitude and longitude to calculate nearby spots. Gusty does not keep this information and excludes it in technical request logs.

Technical and security data

This includes IP address, browser or device information, operating system, app version, request logs, timestamps, crash logs, error logs and security events.

Support data

This includes messages you send to support, screenshots, diagnostic information and other information you choose to provide.

4. How we use personal data

Gusty does not sell personal data.

Gusty does not use personal data for third-party advertising.

Gusty does not currently use cross-site tracking or advertising profiles.

5. Location

Location features are optional. You can use Gusty without granting location access, although some location-based features may not work.

You can withdraw location permission in your browser or device settings.

Gusty uses location only to provide the location-based feature you requested, such as finding nearby spots.

6. Cookies and local storage

Gusty uses necessary and preference storage to run the app, keep sessions working, protect accounts and remember user choices.

Gusty does not currently use advertising cookies, cross-site tracking cookies, marketing pixels or optional analytics cookies.

7. Service providers and data sharing

Gusty shares personal data only where needed to operate, secure and improve the service, or where required by law.

Gusty may use service providers for:

  • hosting and infrastructure;
  • database and authentication;
  • email delivery;
  • logging, security and error monitoring;
  • maps, weather, water, tide or forecast data;
  • app distribution;
  • payment processing, if paid features are introduced.

These providers may process personal data only as needed for their role. Where providers act as processors, Gusty requires appropriate contractual protections.

Third-party map, weather, water, tide and forecast services may receive technical request data, such as IP address, when their services are requested or displayed. Gusty does not intentionally send them your Gusty account profile unless needed to provide the service.

Gusty may also disclose data if required by law, legal process, security investigations, or to protect the rights, safety and integrity of Gusty, users or others.

8. International transfers

Gusty may use providers located outside your country or the European Economic Area.

Where personal data is transferred internationally, Gusty relies on appropriate safeguards where required, such as adequacy decisions, standard contractual clauses, or equivalent legal mechanisms.

9. Retention

Gusty keeps personal data only as long as reasonably needed for the purposes described in this Privacy Policy.

When you delete your account or ask us to delete it, Gusty deletes or anonymises personal data associated with your account unless we need to keep limited information for legal, security, fraud-prevention or accounting reasons.

10. Your rights

Depending on where you live, you may have the right to:

  • access your personal data;
  • correct inaccurate data;
  • request deletion;
  • object to certain processing;
  • restrict certain processing;
  • request data portability;
  • withdraw consent where processing is based on consent;
  • lodge a complaint with a data protection authority.

13. Security

Gusty uses reasonable technical and organisational measures to protect personal data.

No online service can guarantee perfect security. You are responsible for keeping access to your email account and device secure, especially where email-based sign-in is used.

14. Children

Gusty is not directed to children under 13.

If you believe a child has provided personal data to Gusty without the required permission, contact support@gusty.be so we can review and delete the data where appropriate.

15. Changes

Gusty may update this Privacy Policy when the app, legal requirements or data practices change.

The effective date above shows when this Privacy Policy was last updated. Material changes will be made visible in the app or on the website where appropriate.
